Aircraft Management and Part 91/135 

For most executive and business aircraft, the Federal Aviation Administration (FAA) provides two sets of rules under which you can operate. Part 14 of the Code of Federal Regulations (CFR) deals with aviation, and subsection 91 is for private aircraft operators. This would be the case if you or your company purchased an aircraft for personal or company business. You can operate those flights under the relatively relaxed rules of 14 CFR Part 91. However, you are not allowed to operate the private aircraft for profit or compensation.

 

On the other hand, you could also fly the aircraft under 14 CFR Part 135. This would allow you to operate as a private aircraft (Part 91) when transporting company officials, clients or the owner. When not using the aircraft, you could use it as an air charter/air taxi and charge the general public a fee to use your private charter aircraft. The requirements that you must meet to operate an aircraft as an air charter/air taxi operator are much more stringent than those for private aircraft operations. This is because the FAA is protecting the flying public that may use your private charter aircraft. These are a few of the areas the FAA is concerned about:

All Aircraft Ownership Programs Are Not the Same!                                                 

Under most fractional aircraft ownership programs, the private aircraft is operated under Federal Aviation Regulations part 91. Since this means that the private aircraft is only for use by the owners and not for hire, it can never be used for revenue producing flights. Typically, when you buy into one of those programs, you pay a certain amount for your share, say 1/8. Then you pay a hourly aircraft use charge and many times different dubious program fees.

You can always request the aircraft on a specific date in a specific place. But you don’t necessarily get your aircraft or your crew. You get an aircraft and a crew. Our program is very different since we can operate your aircraft under Part 135 of the Federal
regulations to generate revenue as an air charter aircraft and take advantage of some of the benefits that part 135 operations have in increased safety, legal liability and reliability. Crew and maintenance requirements are much higher for aircraft operated under part 135. Also in a typical fractional ownership program you have very limited operational control of your investment. If you want to upgrade the aircraft, say install office equipment, you can usually forget it. With our program the owners decide what they want to do with the aircraft. If for some reason your private aircraft is in maintenance or out on another trip, we have other, similar aircraft we can fly you in, although that is a very rare occurrence.


Offset your Aircraft Ownership costs!

With the typical fractional ownership program there is only expense, and no revenue. Air Broker Net can offer you a share of a private aircraft that is also used on a part 135 on demand air charter certificate to create revenue and offset ownership costs. Actually, you are purchasing a part of a company that owns an aircraft, for the sole purpose of chartering it, thus making all aircraft expenses a tax deduction and minimizing any legal liability on its operation. We crew it, we maintain it, we hangar it. When you or your company are not using it, we will charter it, to generate revenue and therefore offset ownership costs. All of the bills go directly to the company and can be written off in the current year as expenses.

Additionally, federal tax law allows you to depreciate the equipment over five years. You may quickly depreciate 80% of the purchase price in just three years. Used aircraft trade like commodities, but generally, their values only increase, not decrease on an annual basis. At the end of the depreciation cycle, you will be left with an aircraft that is likely worth significantly more than you paid for it.
